Exploring the Intersection of Cybersecurity and Family Law

I am thrilled to share that I recently had the pleasure of being a guest on the Lawyers & Mediators International Podcast, where I had an engaging conversation with attorney Mac Pierre-Louis of MacPierreLouis.com. Our discussion centered on the critical intersection of cybersecurity and family law, an area that is becoming increasingly important in today's digital world.

In this podcast episode, we delved into the significance of privacy and the necessity of protecting personal information, especially in the realm of family law. As a Family Attorney at Beermann Law and a Cybersecurity Consultant at Steele Fortress, I brought my unique perspective to the conversation, emphasizing the growing need for robust cybersecurity measures in legal practices.

Key Highlights from the Podcast

The Importance of Privacy in Family Law

We discussed how essential it is to safeguard personal information during family law proceedings. Court filings, financial affidavits, parenting plans, and even emails between parties can contain highly sensitive data—social security numbers, bank accounts, health information, and details about children’s schedules and locations. Ensuring privacy can protect clients from unnecessary exposure, stalking, harassment, financial fraud, and the potential misuse of their data by bad actors or even by an opposing party.

Securing Personal Devices and Digital Footprints

I shared practical tips on how individuals can clean up their digital footprint and secure their personal devices. These steps are crucial in preventing unauthorized access and protecting sensitive information from hacking and phishing attempts.

This may include:

  • Updating passwords and enabling multi-factor authentication
  • Reviewing app permissions and logins shared with a spouse or partner
  • Backing up important data securely before a separation
  • Being cautious with shared cloud accounts, photo libraries, and location-sharing apps

In family disputes, one of the most common vulnerabilities is a phone, tablet, or laptop that a partner once had access to and can still monitor. Simple steps like changing passwords, logging out of shared accounts, and reviewing privacy settings can significantly reduce this risk.

The Role of AI in the Legal Profession

Our conversation also touched on the use of artificial intelligence in legal practices. We explored how AI can offer significant benefits, such as improving efficiency and accuracy in legal processes—drafting documents, organizing discovery, and analyzing large sets of communications or financial records.

Legal Protection Matters: Cybersecurity incidents often have significant legal implications. Our sister firm Steele Family Law helps Illinois families navigate complex legal situations with the same commitment to protection and discretion we bring to cybersecurity.

At the same time, we discussed the need to use AI responsibly. Lawyers must be careful about what client data is shared with AI tools, making sure that any technology used complies with confidentiality obligations and applicable privacy laws. AI should enhance the attorney’s work, not replace human judgment or compromise client security.

Why Cybersecurity Matters in Family Law

The digital age has transformed the way we handle information, making cybersecurity a vital component of legal practices. In family law, where personal and sensitive information is frequently exchanged, the risk of data breaches and cyber threats is particularly high.

Modern family law disputes often involve:

  • Text messages, emails, and social media posts as evidence
  • Online banking and digital payment histories
  • Parenting apps and co-parenting platforms
  • Cloud-based storage of photos, documents, and videos

Each of these touchpoints creates a potential vulnerability if not handled properly. A weak password, an unsecured Wi‑Fi network, or an unencrypted email can expose critical details about a client’s finances, whereabouts, or children.

Implementing strong cybersecurity measures is not just about compliance; it's about protecting our clients and their most confidential information. It also means educating clients about safer digital behavior—because the strongest law firm security can be undermined if a client’s personal devices and accounts are not equally protected.

Practical Takeaways for Individuals and Families

During the podcast, we also highlighted several practical, user-friendly steps that individuals involved in family law matters can take immediately:

  • Treat your phone like a file cabinet. Lock it, encrypt it where possible, and don’t share your passcode.
  • Audit your accounts. Check who can access your cloud storage, joint email addresses, shared streaming services (which can reveal your location and schedule), and smart-home devices.
  • Be mindful of what you post. Social media activity can have legal consequences; what you share publicly may be used in court and can also increase your exposure to cyber risks.
  • Document safely. If you need to preserve evidence (such as threatening messages), do so in a way that doesn’t compromise your own security—screenshots stored in secure, backed-up locations are often a good start.

These seemingly small actions can significantly strengthen your digital resilience during a highly emotional and vulnerable time.
